1 Plaintiff in Error, Joe Junior Cortez, hereinafter referred to as defendant, was charged by information in the Superior Court of Seminole County with the crime of Burglary Second Degree. He was tried by a jury, found guilty, and sentenced to Two Years in the penitentiary. From that judgment and sentence he has appealed to this Court asserting five propositions of error; the first being that the trial court erred in overruling Motion to Suppress Evidence for the reason that the defendant believed he had a binding promise of immunity from the county attorney.
